Please read these Terms and Conditions ("Terms") carefully before using the Dong Tracker mobile application (the "Service") operated by Dong Tracker ("the Company", "We", "Us" or "Our").

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of the Terms, You may not access the Service.

Eligibility

You must be at least 13 years old to use the Service. By using the Service You represent that You meet this requirement. If You are under the age of majority in Your jurisdiction, You may use the Service only with the involvement of a parent or guardian.

Your Account

When You create an account You must provide accurate information and keep it up to date. You are responsible for safeguarding access to Your account and for any activity that occurs under it. You must notify Us promptly if You believe Your account has been compromised.

You may delete Your account at any time from within the Service. Deleting Your account permanently removes Your profile and any teams You own, and this cannot be undone.

Not a Gambling Service

The Service is a free-to-play fantasy game provided for entertainment. We do not accept wagers, hold funds, or award cash or other prizes of value. No purchase, payment or consideration of any kind is required to participate, and no outcome within the Service entitles You to anything of monetary value.

If You choose to organise any wager or contest of Your own outside the Service, You do so entirely at Your own risk and responsibility. The Company is not a party to, and accepts no responsibility for, any such arrangement, and You are solely responsible for complying with the laws that apply where You live.

No Affiliation with Major League Baseball

The Service is an independent product. It is not affiliated with, endorsed by, sponsored by or otherwise associated with Major League Baseball, MLB Advanced Media, the Major League Baseball Players Association, or any Major League Baseball club. Player names, team names and statistics are used solely to identify real-world athletic performance for the purposes of a fantasy game. All trademarks remain the property of their respective owners.

Statistics shown in the Service are obtained from third-party sources. We make no guarantee as to their accuracy, completeness or timeliness, and We are not liable for any decision You make in reliance on them.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or in violation of any applicable law or regulation
• Harass, threaten, impersonate or abuse other users
• Choose a display name, team name or other content that is unlawful, hateful, obscene, or infringes anyone's rights
• Attempt to gain unauthorised access to the Service, to other users' accounts, or to Our systems
• Interfere with, disrupt, or place undue load on the Service or its infrastructure
• Use automated means to access, scrape or copy the Service, or to manipulate a draft, league or contest
• Reverse engineer, decompile or otherwise attempt to derive the source code of the Service, except to the extent that restriction is prohibited by law

Content You Provide

You retain ownership of the content You submit to the Service, such as team names, league names and profile images. By submitting content You grant Us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely for the purpose of operating and improving the Service.

You are responsible for the content You submit and represent that You have the right to submit it. We may remove content that violates these Terms.

Leagues and Commissioners

Leagues within the Service may designate a commissioner with elevated permissions, including the ability to change league settings, manage rosters and remove teams. Commissioners act on their own behalf and not on behalf of the Company. Disputes within a league are between its members, and We are under no obligation to intervene or to reverse actions taken by a commissioner.

Advertising

The Service is provided free of charge and may display advertising to cover the cost of operating it. Advertising, including any optional rewarded advertising, never gates access to features of the Service. What advertising partners collect, and how You can limit it, is described in Our Privacy Policy.

Advertisements may link to third-party websites or applications that We do not control. We are not responsible for the content, products or practices of any advertiser or third party.

Availability and Changes to the Service

We may modify, suspend or discontinue any part of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service. We will not be liable to You or to any third party for doing so.

Termination

We may suspend or terminate Your access to the Service immediately, without prior notice, if You breach these Terms. Upon termination Your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including ownership, disclaimers and limitations of liability — will survive.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any defect will be corrected.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising out of or relating to Your use of or inability to use the Service.

To the maximum extent permitted by applicable law, Our total liability to You for all claims relating to the Service shall not exceed one hundred United States dollars (USD $100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions the above exclusions and limitations apply only to the extent permitted by law, and You may have additional rights.

Indemnification

You agree to indemnify and hold harmless the Company from any claim or demand, including reasonable legal fees, made by any third party arising out of Your use of the Service, Your content, or Your breach of these Terms or of any law or the rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida, and You consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date above. Material changes will be notified within the Service or by email where reasonable. Your continued use of the Service after the revised Terms take effect constitutes acceptance of them.
